Annual Leave for Irregular-Hours and Part-Year Workers

Introduction

This policy applies to Workers meeting the statutory irregular-hours or part-year defnintions for the relevant leave year. 

52.1  Statutory accrual

For leave years beginning on or after 1 April 2024, statutory leave normally accrues at 12.07% of actual hours worked in each pay period, subject to rounding and the maximum entitlement. A higher contractual entitlement requires an adjusted percentage.

52.2  Accrued/reserve method

Where selected, entitlement and the holiday-pay reserve build up. Holiday pay is released when approved leave is taken or payment in lieu is lawfully due on termination. The rate uses the applicable 52 paid-week reference method, disregarding unpaid weeks and substituting earlier paid weeks within the statutory look-back.

52.3  Rolled-up holiday pay

Where legally permitted, rolled-up holiday pay is a separately itemised 12.07% addition to total pay in each pay period, or the adjusted percentage for enhanced entitlement. Physical annual leave must still be taken; the pay has already been received and is not paid twice.

52.4  Sickness and statutory leave

Entitlement continues during sickness and, for employees, statutory family leave. Under accrued pay it builds in the background and is paid when leave is later taken. Under rolled-up pay, the worker must not lose holiday pay during qualifying sickness or statutory leave; the required amount is calculated under the statutory averaging method.

52.5  Academic and defined breaks

School holidays, assignment shutdowns and planned non-working periods are natural opportunities to take physical leave. Under accrued pay, PGS will where practicable arrange paid annual leave in an agreed break. Under rolled-up pay, no second payment is due, but leave should still be recorded and taken.

52.6  Year-end and termination

June, July and August reminders and the October concession apply to accrued/reserve workers. Statutory sickness and family-leave carry-over can be longer. On termination, entitlement not already paid must be settled.
