Working time, attendance, rest, night work and opt-out

Introduction

This policy applies to all workers within the Working Time Regulations; special transport or sector rules may replace general limits.  

Hours and attendance

Contracted hours, assignment hours and any irregular or part-year arrangement are recorded in the contract, schedule and payroll/time system. Individuals must be ready to work at the agreed time, record time accurately and report lateness, absence or disruption promptly.

Average 48-hour limit

Unless a valid written opt-out applies, average weekly working time must not exceed the statutory 48-hour limit over the applicable reference period. Hours worked for other employers or engagements may need to be included; individuals must provide enough information to manage the limit.

Voluntary opt-out

A Working Time opt-out is voluntary and separate from a Conduct Regulations opt-out. PGS will not impose a default choice or subject a person to detriment for refusing. An opt-out may be withdrawn on the notice allowed by the agreement and law, not exceeding the statutory maximum.

Rest and night work

  • Take statutory daily and weekly rest and rest breaks. A client cannot replace a legal rest entitlement with informal payment unless compensatory rest is permitted.
  • Night workers may be subject to limits and health assessments. Safety-critical duties require fatigue to be raised promptly.
  • Young workers and mobile transport workers may have stricter rules and the general opt-out may not be available.
  • Travel time is assessed under the applicable legal test; ordinary commuting is not automatically working time, while required travel between sites may be.

Excess hours and intervention

PGS will investigate repeated or material excess hours, including work for third parties. The response may include workload review, corrected scheduling, alternative duties, rest or agency/hirer escalation. A worker will not be threatened with termination merely to pressure them into signing an opt-out.

Changes to this Policy

We may update this privacy policy from time to time to reflect changes in legal requirements or our business practices. The updated policy will be published on our website with a revised effective date.
